1. Controller
Monaco Lux Yachts operates pramenoux.com from Monaco and is the controller of the personal data described below. Any question about this policy, or about data held on a particular person, can be sent to [email protected].
2. Data we collect and its source
We collect:
- Enquiry form: name, email, phone (optional), the yacht of interest (optional), charter start and end dates, number of guests, and the free-text message, together with the webpage address and the referring site attached automatically when the form is sent.
- Direct contact: whatever a person shares by email or phone, including name, contact details and the content of the request.
- WhatsApp click: when a visitor taps the WhatsApp button, we record the webpage address, the referring site, the browser language and the prefilled message text before WhatsApp opens. The conversation that follows takes place on WhatsApp itself.
- Visit measurement: pages viewed, time spent, the referring site, campaign parameters carried in the link, device type, browser, operating system, screen size, browser language and the country derived from the IP address. The IP address itself is not stored. If the same visit leads to an enquiry or a tap on a WhatsApp or phone link, that action is linked to the visit so we know which channel brought it.
- Server logs: IP address, time, the page requested and browser, generated automatically by the hosting infrastructure for a short period.
The site stores a small local-storage entry to remember that the cookie notice was closed, a session-storage entry to prefill the enquiry form with the chosen yacht (removed when the tab closes or the form is sent), and a local-storage entry holding random visitor and session identifiers used for visit measurement, which expires 30 days after the last visit and can be cleared from the browser at any time. None of these entries contains contact details, and the site itself sets no cookies.
3. Why we use this data
- Pre-contractual steps and contract: replying to enquiries, preparing a written quote, and confirming, organising and performing a charter once booked.
- Legal obligation: keeping booking and accounting records for the period tax and accounting law requires, and, where a charter is confirmed, collecting guest names for the crew list that Monaco port authorities require before departure.
- Legitimate interest: keeping server logs and reviewing visit data to keep the site secure and to understand which page or channel brought an enquiry, so we can reply promptly through our internal messaging tool.
We do not use personal data for marketing emails unless someone has asked for them, we do not make automated decisions based on this data, and we do not sell personal data.
4. Guest names for a confirmed charter
Once a charter is booked, Monaco port authorities require a crew list showing the identity of everyone on board. For this reason we ask confirmed guests for their full names, and sometimes nationality or date of birth, shortly before departure. This information is passed only to the crew and to the authorities that require it, and only for charters that have actually been confirmed.
5. Who receives the data
- Our own team, who access enquiries through the internal messaging tool used to reply quickly.
- The captain or driver who performs the charter once a booking is confirmed, so the crew knows who is coming aboard and when.
- The hosting infrastructure that serves the static website and keeps standard security logs.
- Google, which loads the web fonts used on the site and receives the visitor's IP address as part of that request, and jsDelivr, which serves the library used for the phone-number field in the enquiry form. Neither sets cookies on our behalf.
- WhatsApp (Meta), for any conversation a visitor chooses to start through the WhatsApp button; that exchange is governed by WhatsApp's own privacy policy, not this one.
6. Transfers outside Monaco
Loading web fonts from Google and sending messages through WhatsApp can involve data leaving Monaco, including to servers located outside the European Economic Area. Where this happens, it occurs under the safeguards required by Monaco Law No. 1.565 of 3 December 2024 on personal data protection and, for visitors located in the European Union, the General Data Protection Regulation. We do not otherwise transfer personal data abroad.
7. How long we keep data
- Enquiries that do not turn into a booking are deleted after 24 months.
- Records relating to a confirmed booking are kept for as long as tax and accounting law requires.
- Server logs are kept for a short period for security purposes only.
- The local-storage identifiers used for visit measurement expire 30 days after the last visit.
8. Security
Enquiries and booking records are held in our own booking system, access to which is limited to the people who need it to prepare quotes and run charters. Server logs are generated and retained by the hosting infrastructure under standard safeguards appropriate to a small static website.
9. Rights, complaints, minors and updates
Under Monaco Law No. 1.565 of 3 December 2024, and the GDPR for visitors established in the European Union, a person may ask us to access, correct, delete or limit the use of their personal data, object to processing based on our legitimate interest, or request a portable copy of the data they provided. These requests can be sent to [email protected]; we answer within one month and may ask for proof of identity before acting on the request.
Anyone who considers that their data has been handled incorrectly may lodge a complaint with the Autorité de Protection des Données Personnelles (APDP) in Monaco.
The site is intended for adults arranging a yacht charter and is not directed at children. We do not knowingly collect personal data from minors other than, where relevant, the names of younger guests included in a confirmed charter's crew list.
This policy may be updated to reflect changes to the site or to the data described above; the version published on pramenoux.com is the one that applies.
